What is a Temporary Health Care Services Agency & Health Care Technology Platform?

Under New York Public Health Law § 2999-ii, it is any person or entity in the business of providing or procuring the temporary employment of health care personnel for health care entities — explicitly including entities that use apps or other technology-based solutions to do so. Task Health is registered in this category.

Who has to register with the Department of Health?

All agencies and platforms operating in this business in New York State, including those based out of state or internationally that procure temporary health care personnel for New York health care entities. Locum tenens and nurses' registries are included as well.

Are home care agencies covered by this registration?

No. Per the statute, temporary health care services agencies do not include home care agencies licensed under Article 36 of the Public Health Law, which are separately licensed.

The statute broadly includes both licensed and unlicensed direct care staff who provide temporary services in a health care entity — anyone responsible for patient handling or patient assessment as a regular or incidental part of their work.
